TERMS AND CONDITIONS, ASSUMPTION OF RISK, WAIVER OF LIABILITY, AND INDEMNITY AGREEMENT.
ALL CLIENTS/PARENT/GUARDIANS MUST READ THIS DOCUMENT BEFORE SIGNING.
Parties & Definitions
Released Parties
Released parties include but are not limited to: Pink Training (owned and operated by Authentic Women/Lisa Turner), Authentic Women, Property at 56 Felix Crescent, Ringwood North.
Releasing Parties include: the participant (client) as well as participant’s spouse, children, parents, guardians, heirs, next of kin, any legal or personal representatives, executors, administrators, successors and assigns, or anyone else who might claim or sue on participant’s behalf.
Session/s
Relates to any Personal Training session that a client(s) has chosen to participate in.
Client/s / Member/s
Includes yourself and other participants.
Cancellation Policy and Procedures
You are required to give a minimum of 10 hours’ notice if you cannot attend a session. If less than 10 hours’ notice is given you will forfeit that session and be required to pay the allocated session cost if payment has not been made prior. If you are attending PT with another member and one of you cancels, full payment is still required. From time to time you will find that 1 member of the 2 on 1 session can not attend, but the other would still like to train. In this event, your trainer will still train 1 of you for the full duration where the client not attending will forfeit that session regardless of notice given. If 1 client can not attend and the other client does not want to attend on their own - both of you must give 10 hours' notice so you do not forfeit that session.
No refunds will be issued for pregnancy, injuries sustained during or outside of your sessions. Under special circumstances or by medical recommendations your trainer may issue a credit at their discretion or transfer your sessions into group options. You may be asked to provide a medical certificate. Any unused sessions if on maternity leave must be used within 3 months of giving birth. Alternatively, you may transfer the session/s to a friend or family member.
Payment
10 or 20 packs are to be purchased upfront in full on or before your first session. 10 packs will be given an expiry of 15 weeks and 20 packs an expiry of 25 weeks from each start date to assist in maintaining accountability.
Session Requirements
Wear comfortable workout clothes and appropriate runners. Please bring a drink bottle and a full-length towel. Please arrive on time to commence your sessions. If you are running late please notify your trainer via phone or text. If you are late, your session time will still finish at the allocated time.
Session Content
Sessions will be structured to suit your goals and needs including modifications for any injuries you may have. Occasionally some session content may be held outdoors. Exercises held indoors or outdoors may include, but are not limited to, running, lifting weights, crawling, weaving, jumping, body weight exercises, boxing, skipping, balancing on unstable objects and partnering with the trainer.
Assumption of Injuries
Minor exercise related injuries can include, but are not limited to, skin scrapes and cuts, bruises, sprains and nausea. Serious injuries are less common but do sometimes occur. They include, but are not limited to, broken bones, torn ligaments, concussions, exposure, heat-related illness, mental stress or exhaustion, infection and concussions. Catastrophic injuries (very rare) can include permanent disability, spinal injuries, paralysis, stroke, heart attack and death. By participating in the training session/s all clients need to acknowledge that it is their sole responsibility to inspect all facilities, equipment and training environments to be used. If any client considers a training activity to be unsafe or poses an unreasonable risk to their health or wellbeing, by their own judgement or notified by others, they must immediately notify their trainer of the perceived risk/s. By participating in the session/s all clients acknowledge that the facilities, equipment and training environments provided are safe and suitable for their individual mental and physical abilities.
Assumption of Property loss or damage
All personal property and belongings at risk of loss or damage during the session are the sole responsibility of the client.
Notification of Health and Injuries
All clients must complete a health screen questionnaire prior to commencing. It is the client’s responsibility to notify the trainer of any changes to health and injury history prior to and during the training session. This includes pregnancy or possible pregnancy. Clients with injuries may choose to continue to participate at their own risk or may stop participating in the session.
Medication
Please bring any medication you require to your sessions. All trainers/contractors are qualified in Level 2 First Aid and CPR.
Indemnity Agreement
I assert that I am in good health and in proper physical condition to safely participate in this session. I certify that I have no known or knowable physical or mental conditions that would affect my ability to safely participate in the session, or that would result in my participation creating a risk of danger to myself or to others. I acknowledge that Authentic Women recommends and encourages each recruit to get medical clearance from a personal physician or doctor prior to participation especially for pre and post-natal women. I assert that I have not been advised or cautioned against participating by a medical practitioner. In the event of an injury to me that renders me unconscious or incapable of making a medical decision, I authorize appropriate personal trainers/contractors present and emergency medical personnel to make emergency medical decisions on my behalf (including, but not limited to CPR and AED). I authorize the trainers/contractors to secure emergency medical care or transportation when deemed necessary. I agree to assume all costs of emergency medical care and transportation.
I affirm that this agreement supersedes any and all previous oral or written promises or agreements. I understand that this is an agreement between me and Authentic Women Personal Training and cannot be modified or changed in any way by representations or statements by any contractor or employee of Authentic Women. This Agreement may only be amended by a written document or by the director. I understand that this agreement is valid for all programs/sessions run by Authentic Women unless presented with an amended document that will supersede this one.
I have read the preceding paragraphs and acknowledge that I understand and agree to these terms and conditions.
